Rights and Duties As usual in business life, there's a legal
regularisation for the booking of rooms, too. A reservation that has been made by a guest
and is accepted by a host, causes a contractual relationship between both parties,
which is called guest's accomodation contract. As well as all contracts this one
can be suspended just by mutual agreement of both parties. In detail there
result following rights and duties from the contract: 1. The guest's accomodation contract is concluded as soon as the room has
been ordered and accepted or if an acceptance wasn't possible any more because
of temporal reasons, but the room had been made available. 2. The conclusion of the guest's accomodation contract obliges the
contractual partners to fulfilment, no matter of the contract's duration. 3. The host has the duty to pay damages, if he doesn't provide the
room. 4. The guest is obliged to pay the costs as aggreed or customary in case of
non-usage, less the host's saved disbursements. 5.a The host is obliged in all conscience to let the room otherwise if
it hasn't been used, to avoid losses. 5.b Until the room is let otherwise, the guest has to pay for the
outstanding amount (as calculated according to point 4) as long as the contract dures so
far.
